Terms
Terms of Use
What this site is, what it is not, and the limits that apply to it. Nothing here creates a contract: engagements run on a separate signed agreement.
Last updated 10 September 2026
These terms govern your use of averywoodbury.com. Using the site means you accept them. If you do not, please do not use the site.
Nothing here is a contract
This site describes services and shows work that has been done. It is information, not an offer capable of acceptance. Nothing on it creates a contract, a retainer, or any obligation to provide services.
Any engagement begins only when a separate written agreement is signed by both sides. That agreement sets the scope, the price, the timetable, the ownership of what is produced, and everything else that matters. Where this site and a signed agreement disagree, the signed agreement governs.
Descriptions of how pricing works, of response times, and of what a project includes are general indications of how the studio usually works. They are not quotations, guarantees, or binding commitments.
No guarantee of results
Marketing, search visibility, and commercial outcomes depend on many things outside anyone's control, including your market, your pricing, your products, your competitors, and the decisions of search engines and platforms. No specific result is promised. That includes, without limitation, sales, revenue, profit, traffic, search rankings, conversion rates, followers, or approval by any marketplace, payment provider, app store, or advertising platform.
About the examples shown
The work shown on this site is the studio's own businesses. It is offered as evidence that the work was built and is running, not as a forecast of what any other business will achieve. Figures such as prices and product counts describe those businesses at the time of writing and may change without this site being updated.
No professional advice
Nothing on this site is legal, tax, accounting, financial, or regulatory advice. Subjects such as business structure, taxation, consumer law, shipping and customs, product compliance, and data protection require a qualified professional in your jurisdiction. Always take your own advice before acting.
Intellectual property
The design, code, text, images, and arrangement of this site are owned by Avery Woodbury and are protected by copyright and other laws. You may view the site and print or save pages for your own reference. You may not copy, republish, sell, or reuse any part of it commercially, or present it as your own work, without written permission.
Names, logos, and trade marks belonging to other businesses remain the property of their owners and appear here only to identify them.
Acceptable use
Please do not use this site to break the law, to send unlawful, abusive, or deceptive material through the contact form, to attempt to gain unauthorised access to it or the systems behind it, to interfere with its operation, or to harvest data from it by automated means.
Links to other sites
This site links to businesses and services run elsewhere. Those sites are not under this studio's control, and no responsibility is taken for their content, their products, or their privacy practices. Following an external link is at your own risk.
The site is provided as it is
This site is provided on an "as is" and "as available" basis. To the fullest extent the law allows, all warranties are disclaimed, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No promise is made that the site will be uninterrupted, error free, secure, or free of harmful components, or that any information on it is complete, current, or accurate.
Limitation of liability
To the fullest extent the law allows, Avery Woodbury is not liable for any indirect, incidental, special, consequential, exemplary, or punitive loss arising out of your use of this site, and is not liable for any loss of profit, revenue, business, goodwill, data, or anticipated savings, whether or not such loss was foreseeable.
Where liability cannot lawfully be excluded, total liability arising out of or connected with your use of this site is limited to one hundred United States dollars (US$100).
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Indemnity
You agree to cover Avery Woodbury against claims, losses, and reasonable legal costs arising from your misuse of this site or your breach of these terms.
Accessibility
This site is built to be usable by as many people as possible. It works without a mouse, respects a request for reduced motion, keeps text readable against its background, and carries text alternatives for meaningful images. Accessibility is treated as ongoing work rather than a finished state. If any part of this site is difficult for you to use, write to avery@seldomdreams.com describing the problem, and it will be looked at and fixed where it can be.
Privacy
How information is handled is set out in the Privacy Policy, which forms part of these terms.
Changes
These terms may be updated. The version published here, with the date at the top, is the one that applies. Continuing to use the site after a change means you accept the revised terms.
Governing law
These terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of laws rules. The courts of Connecticut shall have jurisdiction, except that either party may seek injunctive relief wherever necessary to protect its intellectual property.
General
If any part of these terms is found unenforceable, the rest continues to apply. A delay in enforcing any part of them is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement about your use of this site.
